Last Wednesday, a group of 9/11 family members and New York first responders attended the Senate Judiciary Committee hearing in which Attorney General Eric Holder testified about his decision to prosecute Khalid Sheikh Mohammed and the 9/11 co-conspirators in a New York City federal court. Mr. Holder stumbled through several tough and pointed questions about the dangers of giving war criminals the same rights as American citizens and blurring the mission of our war fighters. He was visibly unnerved by the presence of the families and the first responders. We want to keep the pressure on him, as well as President Obama, who we were shocked to learn was AWOL on this reckless decision.
Nearly two weeks ago we sent a letter signed by 300 family members to President Obama, AG Holder and Secretary of Defense Robert Gates. After Mr. Holder’s announcement last Friday, another 120,000 people (as of today) have signed the letter in support of our position. Many of these individuals are family members from all three attack sites, active & retired FDNY, PAPD & NYPD, first responders from throughout the country and active, reserve and retired members of the military.
We are holding a press conference on Tuesday, November 24, at noon in Battery Park, Clinton Castle for the 9/11 families and first responders/survivors.

Americans for Tax Reform (ATR) has reviewed H.R. 3962, the “Affordable Health Care for America Act” that has been introduced by Nancy Pelosi –all 1990 pages of it.  ATR points out that this gargantuan beast contains thirteen new tax hikes.  Here they all are, with description and page number:

•  Employer Mandate Excise Tax (Page 275): If an employer does not pay 72.5 percent of a single employee’s health premium (65 percent of a family employee), the employer must pay an excise tax equal to 8 percent of average wages. Small employers (measured by payroll size) have smaller payroll tax rates of 0 percent (<$500,000), 2 percent ($500,000-$585,000), 4 percent ($585,000-$670,000), and 6 percent ($670,000-$750,000).

•  Individual Mandate Surtax (Page 296): If an individual fails to obtain qualifying coverage, he must pay an income surtax equal to the lesser of 2.5 percent of modified adjusted gross income (MAGI) or the average premium. MAGI adds back in the foreign earned income exclusion and municipal bond interest.

•  Medicine Cabinet Tax (Page 324): Non-prescription medications would no longer be able to be purchased from health savings accounts (HSAs), flexible spending accounts (FSAs), or health reimbursement arrangements (HRAs). Insulin excepted.

•  Cap on FSAs (Page 325): FSAs would face an annual cap of $2500 (currently uncapped).

•  Increased Additional Tax on Non-Qualified HSA Distributions (Page 326): Non-qualified distributions from HSAs would face an additional tax of 20 percent (current law is 10 percent). This disadvantages HSAs relative to other tax-free accounts (e.g. IRAs, 401(k)s, 529 plans, etc.)

•  Denial of Tax Deduction for Employer Health Plans Coordinating with Medicare Part D (Page 327): This would further erode private sector participation in delivery of Medicare services.

•  Surtax on Individuals and Small Businesses (Page 336): Imposes an income surtax of 5.4 percent on MAGI over $500,000 ($1 million married filing jointly). MAGI adds back in the itemized deduction for margin loan interest. This would raise the top marginal tax rate in 2011 from 39.6 percent under current law to 45 percent—a new effective top rate.

•  Excise Tax on Medical Devices (Page 339): Imposes a new excise tax on medical device manufacturers equal to 2.5 percent of the wholesale price. It excludes retail sales and unspecified medical devices sold to the general public.

•  Corporate 1099-MISC Information Reporting (Page 344): Requires that 1099-MISC forms be issued to corporations as well as persons for trade or business payments. Current law limits to just persons for small business compliance complexity reasons. Also expands reporting to exchanges of property.

•  Delay in Worldwide Allocation of Interest (Page 345): Delays for nine years the worldwide allocation of interest, a corporate tax relief provision from the American Jobs Creation Act

•  Limitation on Tax Treaty Benefits for Certain Payments (Page 346): Increases taxes on U.S. employers with overseas operations looking to avoid double taxation of earnings.

•  Codification of the “Economic Substance Doctrine” (Page 349): Empowers the IRS to disallow a perfectly legal tax deduction or other tax relief merely because the IRS deems that the motive of the taxpayer was not primarily business-related.

•  Application of “More Likely Than Not” Rule (Page 357): Publicly-traded partnerships and corporations with annual gross receipts in excess of $100 million have raised standards on penalties. If there is a tax underpayment by these taxpayers, they must be able to prove that the estimated tax paid would have more likely than not been sufficient to cover final tax liability.

Job Killers for Health Care Reform

There is one supreme Democratic idiocy in the health care debate which has not received enough attention. The entire focus of the Democratic proposals  whether HR3200, the Senate HELP Committee bill, the Baucus Concepts, or the Obama non-plan — is to increase the cost of private health insurance.

That may sound counter-intuitive, because all the rhetoric from the Democrats is about reining in costs and bending the cost curve. But when Democrats talk about reining in costs, what they really mean is de facto rationing determined by Democratically (large D) appointed panels for those people on government-run plans.

Democratic health care mandates will lead to greater incentives to shift employment resources to other countries, where there are no such costs. Add to it other tax increases from cap-and-trade and personal tax increases on successful employers, and we are setting ourselves up for the type of permanent double-digit unemployment which has existed for decades in western Europe.

UPDATE: Everyone is a day late on the point of my post, but finally the message is getting out – New Bill Would Raise Rates, Says Insurance Group:

Now The Taliban is Not Really An Enemy According to Obama and his Liberal IDIOT MORON Cronies:

Hot Air is reporting: The new White House spin the Taliban aren’t really the enemy. They actually have a role in Afghanistan’s future according to the geniuses occupying the White House.

Rather than eating crap by forthrightly admitting he’s prepared to abandon huge swaths of the country to Islamist fascists, and rather than invest another 40,000 troops, Obama’s going to create an artificial distinction between the Taliban and Al Qaeda to let him save face by claiming he’s focused on “the real enemy.”

Much like how he was focused during the campaign on “the good war” in Afghanistan rather than “the bad war” in Iraq.  I wonder how long it’ll be before he decides that not everyone who’s in Al Qaeda is an enemy either or, better yet, that Al Qaeda’s been “substantially defeated” or something, which has been the unstated thrust of all those White House-leaked pieces in the press lately about how weak Bin Laden’s gang has become.  Why, I’ll bet in a year or so we’ll be told that they’re so weak that we can start pulling out of Afghanistan altogether.  Things sure have improved over there since Bush was president, huh?

How this squares with what Bob Gates said just days ago about the colossal danger of giving the Taliban a propaganda victory, I have no idea.

This afternoon, the House is slated to vote on Speaker Pelosi’s job-killing energy tax.  In a press briefing yesterday, House Republican Leader John Boehner (R-OH) said: “Mark my words: The American people are going to remember this vote.  This will be a defining moment and a defining vote in this Congress.” 

Newspapers across America have ripped into Speaker Pelosi’s energy tax this week, slamming it as a bill that will raise electricity prices, increase gasoline prices, and ship American jobs overseas to countries like China and India.  A roundup of newspaper editorials from across America follows:

The Denver Post:

The debate on such a transformative issue ought to continue and broaden.  How is it possible the 1,200-page American Clean Energy and Security Act is being rushed through Congress in a repeat of what happened with the stimulus package?  Has anyone read this one?…

Largely left out of the current debate are questions about nuclear power.  House Republicans say reducing CO2 depends on more atomic development.  And for good reason.  Nuclear power generation produces zero greenhouses gases and the technology far outpaces renewables like wind and solar in the amount of electricity it can add to the grid.”

Investor’s Business Daily:

Not since a misguided piece of legislation imposed tariffs that turned a recession into a depression has there been a piece of legislation as bad as Waxman-Markey.  The 1,000-plus-page American Clean Energy and Security Act (H.R. 2454) is being rushed to a vote by House Speaker Nancy Pelosi before anyone can seriously object to this economic suicide pact.

Since 85 percent of U.S. energy comes from hydrocarbons, almost all use of energy would become more expensive due to the necessity to buy permission to emit a constantly declining amount of carbon dioxide every year.  Thus the system would be a hidden tax on energy that would cost every American, including the middle class and lower-income people that President Barack Obama promised he would never tax.

The Deseret News (Utah):

Cap and trade would end up raising the cost of electricity to the point where Americans would have little choice but to use less.  That means they would be forced into buying fewer laptop computers, iPods, televisions and other electrical appliances.  It means the move toward hybrid automobiles would be stymied, as the cost of running one would increase dramatically.  Technological innovation would begin to dry up as venture capitalists would grow suspicious of any new idea that would require electricity.  And, it is worth noting, this increase in energy costs would hurt the poor more than any other group.

The Detroit News:

This bill will break the budget of U.S. households….[the American Institute] warns the cap-and trade-bill co-sponsored by Reps. Henry Waxman, D-Calif., and Edward Markey, D-Mass, could double the price of natural gas, the favored fuel for home heating in Michigan.  Electricity costs could rise more than 100 percent in the Midwest.

The Wall Street Journal:

The hit to GDP is the real threat in this bill.  The whole point of cap and trade is to hike the price of electricity and gas so that Americans will use less.  These higher prices will show up not just in electricity bills or at the gas station but in every manufactured good, from food to cars.  Consumers will cut back on spending, which in turn will cut back on production, which results in fewer jobs created or higher unemployment.  Some companies will instead move their operations overseas, with the same result.

The Chicago Tribune:

If anyone in Congress tells you that he has read and completely understands this bill, and can explain exactly how the system to reduce carbon emissions would work and what its effects would be, he’s lying.
